Deposits:     A standard 30% deposit is required to process furniture orders. Pillows, fabric orders, table pads, etc. must be paid in full at time of order.

Method of Payment:     Furniture Mart accepts cash, personal or cashiers checks, most major credit cards, and financing may be arranged with approved credit. If financing is desired, all arrangements and documentation must be signed before the order is processed.

Merchandise purchased must be paid in full prior to delivery.

Customers Responsibilities:     Please review your order carefully, and double check to ensure accuracy. Furniture Mart does not move your existing furniture so please have your area ready in advance of the arrival. It is buyer's responsibility to measure openings for size of furniture purchased.

Delivery:     Two men will set up the furniture in your desired location. Our delivery men do not handle electronics, cut out the backs of entertainment centers, or hang items on the walls. No exceptions! Furniture Mart can not be responsible for damages to floors or walls when it is found difficult to maneuver the furniture through narrow halls, doorways, or stairwells. Furniture Mart delivery men are not required to carry furniture on to construction sites that pose safety issues.

Cancellations:     In the event that an order is canceled before the manufacturer has placed it into production, we will give a full refund. However, this is the only circumstance in which a full refund will be granted. Furniture Mart does not order on approval. Special Order merchandise is not subject to cancellation, return or exchange. If the item you wish to cancel is deemed acceptable to Furniture Mart inventory, a 30% fee will be charged to offset incoming freight and handling charges that we remain responsible for.

Delivery Time:     Most furniture orders take approximately 8-12 weeks. About four weeks after you place your order, Furniture Mart should have the information from the manufacturer as to an estimated date they expect to ship the item from the factory. As a general rule, Furniture Mart cannot promise a particular delivery date until your order has been received in our warehouse.

Availability:     We will be happy to provide you with estimated delivery dates; actual availability may vary from this estimate. We have no control over production or delivery schedule changes made by factories or over the accuracy of information furnished to us by the manufacturer. Buyer agrees that changes in availability will not invalidate this order. The seller shall not be responsible for delays or defaults in the delivery occasioned by weather, war, strikes, acts of God, the public enemy, fire, labor or transportation difficulties or other cases beyond the control of the seller.

Delayed deliveries:     Unless the delay is caused by the seller, items must be delivered as they are received in our warehouse. Purchasers must take possession of their order within 30 days of notification that the merchandise is available for delivery . If delivery is delayed by the buyer for any reason beyond 30 days, buyer must pay the balance in full. If the purchaser does not take possession of the order within 60 days, seller may cancel the order and keep all deposits as liquidated damages. Any deviation from these time constraints must have been agreed upon in writing at time of placing the order.

Damages:     All Furniture is opened and inspected prior to delivery, in the event that damage occurs Furniture Mart will repair or replace at our discretion.

* Seller makes no warranties beyond the written description of the goods on the face hereof unless otherwise stated by seller in writing. Seller expressly disclaims any warranty of merchantability or fitness for a particular purpose. This disclosure does not affect manufacturer's warranties if any.

* Sales Tax may be adjusted according to state regulations prevailing at the time of delivery.

* Errors in pricing, mathematical and inadvertent errors are subject to revision by seller.

* Any order may be cancelled by seller for any reason upon refund of any deposits.

* Other terms of sale may be contained in other agreements between buyer and seller.

* Refunds for merchandise purchased by check will be made after proof that the check has cleared is provided to the seller.

* Buyer acknowledges receiving a true copy of this order.
